Hosting Service Agreement

1. INTRODUCTION

This Hosting Service Agreement ("Agreement") is entered into by and between Stonfa ("we," "us," "our"), a product of BlueEcom FZ LLE, and the user ("you," "your") who subscribes to our website hosting services. By accessing or using our hosting services ("Services"), you agree to be bound by the terms and conditions of this Agreement. If you do not agree with any part of this Agreement, you must not use our Services.

2. Scope of Services

2.1 Hosting Services: Stonfa provides website hosting services as part of its platform offerings. These services include storing website files, databases, and content on our servers, making them accessible via the internet.

2.2 Features: The hosting services include, but are not limited to:

  • Website storage and maintenance
  • Domain name management
  • SSL certificates
  • Regular backups and security monitoring

2.3 Exclusions: Our hosting services do not include custom development, ongoing website management, or content creation beyond what is generated by our AI tools.

3. User Responsibilities

3.1 Account Information: You are responsible for providing accurate and complete information when creating your account. You must update this information to keep it current and accurate.

3.2 Content Management: You are responsible for all content uploaded, published, or stored on your hosted website, including ensuring that such content complies with applicable laws and this Agreement.

3.3 Prohibited Uses: You may not use our hosting services to:

  • Host or distribute illegal content
  • Engage in activities that violate the intellectual property rights of others
  • Use excessive bandwidth or resources that disrupt or interfere with the Services
  • Attempt to gain unauthorized access to our servers or networks

4. Service Level Agreement (SLA)

4.1 Uptime: Stonfa is committed to providing a reliable service with a target uptime of 99.9%. We strive to ensure that your hosted website remains accessible at all times, subject to the terms outlined in this Agreement.

4.2 Maintenance and Downtime:

  • Scheduled Maintenance: We may perform scheduled maintenance on our servers to improve or update our Services. We will provide advance notice of any scheduled downtime, and we will strive to perform maintenance during off-peak hours to minimize disruption.
  • Emergency Maintenance: In the event of unforeseen issues that require immediate attention, we may perform emergency maintenance. We will work to resolve these issues as quickly as possible to restore Services.

4.3 No Service Credits: Stonfa does not offer service credits or refunds for downtime, regardless of cause, including but not limited to scheduled maintenance, emergency maintenance, or force majeure events.

5. Data Security and Backups

5.1 Data Security: We employ a variety of technical and organizational measures to safeguard your data against unauthorized access, alteration, disclosure, or destruction. These include, but are not limited to:

  • Encryption of data at rest and in transit
  • Access controls and regular security audits

5.2 Backups: Stonfa performs regular backups of your website data. However, we recommend that you also maintain your own backups of important data, as we cannot guarantee the restoration of data in every situation.

5.3 Data Loss: Stonfa is not liable for any loss of data, including data lost due to server failures, human error, or unauthorized access.

6. Domain Management

6.1 Domain Registration: As part of our Services, you may register a domain name through Stonfa’s integrated domain management system. Domain registration is subject to availability and the terms of the applicable domain registrar.

6.2 Domain Renewals: It is your responsibility to ensure that your domain name is renewed before its expiration date. Stonfa may offer automatic renewal services, but we cannot guarantee that your domain will be renewed unless you have enabled this feature.

6.3 Domain Transfers: You may transfer your domain to another provider at any time, subject to the terms of this Agreement and the policies of the domain registrar. Stonfa will assist with domain transfers upon request.

7. Termination and Suspension

7.1 Termination by You: You may terminate your hosting services at any time by contacting customer support or through your account settings. Termination will take effect at the end of your current billing cycle.

7.2 Termination by Stonfa: We may terminate or suspend your access to the hosting services immediately if you breach this Agreement, fail to comply with legal requirements, or engage in activities that harm the Services or other users. We will make reasonable efforts to provide notice before terminating or suspending services.

7.3 Effect of Termination: Upon termination, your hosted website will be deactivated, and all associated data may be deleted. We recommend that you back up your data before terminating the service.

8. Limitation of Liability

8.1 No Liability for Downtime: Stonfa is not liable for any downtime or service interruptions, regardless of cause, including but not limited to scheduled maintenance, emergency maintenance, or force majeure events.

8.2 Indirect Damages: To the fullest extent permitted by applicable law, Stonfa is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our hosting services.

9. Governing Law and Jurisdiction

9.1 Governing Law: This Agreement is governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of laws principles.

9.2 Jurisdiction: Any disputes arising out of or related to this Agreement shall be resolved exclusively in the courts of Dubai, United Arab Emirates.
